Tell them to show you the law, not tell you the law, on paper in print. If they say it's an Act, that's not a law. Acts are Statues that have the force of law only, and I mean ONLY, if you the individual gives your CONSENT to follow that Act=Statue.

I (Ryan Dawson) thank you all, and to be clear, this is not a political party issue. It was a Republican Judge and Democratic congress who have shot us down so far. It has nothing to do with parties but I am glad that the GOP is finally listening to us and appears to be on the right side. (for this issue)

Also THANK you to everyone who could attend the Commissioners meeting on June 15th. I think even though it's a lot of preaching to the choir the most important thing is that we filmed the whole thing. I had my own camera man and a CNN reporter was there who is now working with me to rip Judge Boyle down to size and reverse his decision.

Ill have copies of the meeting up on youtube later as they get processes from quicktime to flash. The Anglers Club has a meeting Saturday June 20 and 7pm I hope you will all be there.

I'm asking them if I can speak again so that I can finish the rest of my speech that I was not permitted to say given the time restrictions of the commissioners meeting.

The case is pretty simple, as I explained in my speech. So all we are really lacking right now is the proper media attention. Part of this is because the Park Service has not allowed us to film at meeting where the public was allowed to speak and now they won't even hold meeting on the Island. Here is the solution. We hold our own meetings and we film it ourselves. I had the entire meeting (which was not aired on TV today for whatever reason) filmed by my own friend (who is a documentary make from New York).

If we gather enough footage of the outrage from the public we can take it directly to the press and our congress. Face it most of congress doesn't even read the bills they sign. They just vote down party lines. And in their minds they wrongly assume this is an issue about the environment. We have to make a FILM for them to watch, or for our rep to present on the house floor so that they can be made aware of what is REALLY going on.

They've never seen it. They gotten phone calls but they haven't seen the rooms pack with people full of horror stories. Once this thing goes to the MSM and congress its not over. We need to go on the offense and sue the judge and all the affiliated groups who brought this on.

I don't think we really have to poke around at what all harm has been done or not done to certain birds. It's irrelevant because its not a wild life preserve anyway. This was all explicitly explained when the park was created and that the adjacent lands (like Pea island) were deemed sufficient for the birds etc. It's congressional law and it can't be overturned by one judges interpretation of one executive order from tricky dicky. That's completely unconstitutional. Judge aren't supposed to make laws. They only supposed to determine if you have broken one or not. And executive orders to not trump congressional laws. That's common sense that an 8th grader can tell you.

there is a link to the speech I gave, other videos are up loading (they'll be on the same youtube channel. (thanks to Jon in Avon for the computer work and filming) I especially like the first gentlemen's point about how wrong it is to give collective punishment for the sins of one individual and leaving the burden of prevention on the people not the police. Also in the link, in blue, are the parts of the letter that were not read.

Below is some more comments I have addressing general feedback I got. And I appreciate the constructive criticism, so I hope you can hear mine. I have some words about the judge, the NPS, and our government.

As for the judge (this is addressing some skeptics.)

It's not just all the stupid/illegal things Boyle has done that hurt his credibility that make his decision reversible. It's not just a Salon report and a bunch of angry groups either. It's the decision itself. We have congressional laws creating our National Seashore as I know you know. An interpretation of an executive order from Nixon does not and can not create a new law, or change the recreational park into a de-facto wild life preserve. It's unconstitutional. You and I both know what is right. We all know the same stuff. Our problem isn't our argument. Our problem is the lack of media, and lack of understanding in congress. People have allowed this debate to be framed in a way that pits us proving that birds are not being harmed. Guilty until proven innocent. The fact is it wouldn't matter if there were no birds at all because it's a park for recreational use, and the law already explicitly stated how to resolve conflict with the wild life it's called Pea Island.

Sadly being right isn't what makes things happen. Being in the media is what makes things happen. That's got to be more of a focus.

Nixon's resolution is dealing with hiking trails and four-wheelers and ORV in mountain parks. It's clearly talking about that in Section 3. The only part that could be twisted to concern Hatteras is Sec 9 which falls back on Sec 3. The judge is just creating a new law. (which is illegal).

As for the NPS

The NPS is not "just doing their job" because there job is to provide access to the beach not limit it. I have evidence in other parts of the US in Cape Cod, in New Jersey, in California, and Michigan, where they used the same trio to close down beaches and then a "compromise" came along where the NPS privatized the beach to themselves and charged people parking passes and permits in order to "manage" traffic on the beach and use the "environmental" pretext to do it. They're working in collusion with SEL and Audubon. They don't give a damn about the Island they are the idiots who burn the forest and cause much of the erosion that they were initially hired to prevent. They are getting lump sums of 300 thousand dollars to police the beach and shoot animals. They PROFIT from this. They have no interest in making a speedy or fair plan to open the beaches. They are not a neutral party.

Our government

Our own commissioners seemed to think the NPS is just doing its job, in fact our own rep said that. One of them also thinks he may have voted for a judge and that we should not vote for bad judges.That was his advice at the meeting. That's so ignorant. Federal Judges are appointed at the Federal level. We don't vote for them. And he just heard me read and explain that. Which means he was not listening. It's embarrassing. How do people in government not know how it works? I mean that like 8th grade civics. Our own rep got up there and said "butt holes". Which I personally don't have a problem hearing in an informal place but not on TV, and not in a commissioners meeting. But that's what we have on our side, so we have to work with it.

We have a deep problem in America when all of our commissioners, our Congressional representative, and both senators all agree on something but can do nothing. Basically ALL of our ELECTED officials for our area agree that something is unjust and yet they are powerless to do anything about it. This is constitutionally backwards. The power of the law resides in congress, the ELECTED representatives, for a reason. This judge is making a law (which is illegal) based on a 40 year dated executive order (which can also not make laws). It's a federal law that passed through multiple presidents undisturbed. Clearly Boyle is aiming to retire and sit on a boards of one of these nutty organizations. Clearly the Park Service does not give a damn about the island. The are so many other issues that prove that.

How can the commissioners claim "they know all this already or have heard it all already" when they obviously do not and have not. I think Boyle can be reversed. I think our reps, though on our side, just don't know what the hell they are doing. Congressman Jones is an idiot. This is the same moron that put NC on the map by suggesting that we change the name of French Fries to "Freedom Fires." I'm not resting my hopes on Walter Freedom Fries Jones. You ever listen to this guy speak on CSPAN, he's worse than Bush. He couldn't get HR 718's identical bill pushed through the last time because of party politics. It was divided straight down the line between Democrats and Republicans. When has he come down here? Why hasn't footage already been taken of these meetings and sent to congress and the press on DVDs?

We just can't afford to keep talking to ourselves. If it's not on tape, then it is like it didn't happen. I give full support to our supporters in the government, but that doesn't mean we can't improve them at the same time. Some of you activists in these groups fighting for the past years should think about running yourselves. I'll support your campaign.

Come to the meeting Saturday. I'm not speaking. But a Dr is going to talk about pusedo-environmentalism and environmental science. Be there to ask him questions at the end. 7pm anglers club.

Cape Hatteras national seashore, America’s oldest recreational seashore has been shut down to the public. Even though the public unanimously wants the beaches open, and the state representative, both senators, and all of the local commissioners agree that the beaches should be open, it is closed. For nearly a century Cape Hatteras has had an open public beach for locals and visitors. But because of one federal judge’s interpretation of one executive order from the impeached President Nixon that a special interest group dug up, the shoreline is now closed. The entire elected government is being ignored, and the will of the people is being ignored so that a special interest group that doesn’t even live in the effected area can have its way. And a more covert motivation may be at play with the National Park Service and the Judge.

The economic impact has been devastating. Tourists from as far away as Canada annually drive to North Carolina to enjoy the pubic beaches. They are saying now, ‘I won’t come down anymore.” The beach has been taken away from them. Our government promised us that the land would remain recreational and the Island economy is completely dependent on tourism. Our way of life and our culture have been stripped away from us. The vacation spot for hundreds of thousand of Americans has been ruined because of a psuedo-environmental organizations wishes to change the legally recreational park into a de-facto wild life reserve without going through congress and making any new laws. How can the life line of so many Americans be taken away from them without allowing the residents of the area having any say in the matter? Everything was done because of the whims of a questionable judge.

It is unconstitutional for a judge to use a consent and decree to create a new law. Judges don’t make laws, they only interpret if you break them or not. Consent and decree which was asking, “do you want 30% of a beach or no beach?” is about as valid of a question as choosing which of your arms you want removed. It’s a load leveraged question to force one to accept the lesser of two unnecessary evils. Not calling it a law, does not change its results anymore than renaming torture to enhanced interrogation techniques changes the acts of torture.

Cape Hatteras National Seashore was created in light of the Florida housing boom in the 1920s. Fearing over development and a private playground for the rich, the government decided to make recreational seashores which could be enjoyed by all but owned by none. Wholly separate from that they also created Wildlife Reserve specifically for animals.

The national seashores are for the public’s enjoyment. They were not and never have been wild life reserves.

But because of one judge over 70 miles of public beach have been shut down. Over 90 years of beach goers’ enjoyment has ended on the pretext of saving a bird which isn’t even endangered. There isn’t any real science to back the claims about the bird or that the people on the beach have caused any conflict with the bird. Furthermore it’s not a wild life reserve, and even if it was the government should not allow 90 years of standing law being circumvented by a decree from a judge. The will of the people, especially the communities living on the Outer Banks, have been completely ignored. This is NOT how representative government is supposed to work.

We need the ACLU and the Campaign for Liberty to stand up for the numbers. We might not have the money and the judge, but we are the majority. We are Americans, and we have a right to what was promised to us when the government took the land. We have a right to continue to use our recreational beach that was designated so through the normal process of law created by our elected government. We cannot allow for judges to wield power like regional dictators who answer to no one and bare no responsibility for their bad decisions.

I got trashed by a local paper today or so I heard from my brother and his wife. I haven't had a chance to look at it. A big problem we have down here are all these groups with so much ego invested in their little factions. It's like they got some notarity from their little websites which do little more than talk in circles and create active excuse makers, and they can't stand it when someone breaks from the mold. Not every one at the public comment was smooth or used to speaking in public, there were a lot of shaking complaints that went all over the place. I say so what that's great. That's normal. These are normal people doing something they don't want to do because they are so desperate. People (all people) should speak out when the government is neglecting/abusing them. The media and the local government need to see the hardship straight from the mouth.

My friend Jon and I are making a commercial for the beach. Not everyone has the means to do that. But it is completely fucked up to trash those who are trying to help and are speaking their mind at a PUBLIC HEARING where they are supposed to be doing that. It's feedback to the local government who is supposed to carry it on up the ladder.
